1. Terms of Agreement
The parties hereby bind themselves to the terms of this Agreement concerning all equipment rented by the Customer from McB Rentals, effective from the date of the Rental Agreement until modified, terminated, or until all obligations of the parties are fully satisfied. The individual named in the Rental Agreement will be referred to as the “Customer.”
2. Definitions
-Company: Refers to McB Rentals, the firm providing rental services.
– Customer: Refers to the individual engaging with McB Rentals to rent equipment.
– Service: Refers to the rental of equipment by the Company.
3. Eligibility
Customers eligible to engage in rental services must be individuals in the media industry, including videographers, photographers, filmmakers, and others. All customers must possess legal rights to work in the country and have a professional reference to vouch for their integrity. Provisions are also available for non-citizen customers.
4. Services Offered
McB Rentals offers the rental of media equipment, including cameras, lenses, lights, and related accessories. We serve customers nationwide.
5. Pricing and Payment Terms
- The Rental Agreement specifies the amount and schedule of payments owed by the Customer to McB Rentals.
- Customers are required to make a 100% payment prior to equipment pickup.
- In the event of order cancellation, 30% of the rental price will be deducted, provided the order was confirmed and the Company had to decline other potential rentals.
- Customers are permitted to make changes to an order. However, delayed returns will incur costs based on the number of days the equipment is not returned.
6. Inspection
Customers must complete a thorough inspection of the rented inventory with a McB Rentals representative before leaving the premises. By leaving the premises with the equipment , the Customer acknowledges that the equipment is in good working condition. All third-party operators and handlers of the equipment are also bound by these Terms and Conditions.
7. Delivery
Upon request, McB Rentals will deliver the Customer’s order to a verified address. All delivery costs will be borne by the Customer, and fully insured overnight delivery is required. Customers must notify McB Rentals of any issues within one hour of delivery; otherwise, the equipment will be deemed to be in good working condition. The inventory must be returned by the date specified in the Rental Agreement, and an inspection must be completed before return delivery.
8. Use and Care of Inventory
- Customers agree to use and maintain the equipment per the Manufacturer’s Instructions and any Rental-specific guidelines.
- Modifications to the equipment are not allowed without prior written consent from McB Rentals, which may be withheld at the Company’s discretion.
- Customers must not misuse or abuse the equipment or use it unlawfully. Prior authorization is required to remove the equipment from the state or country.
- McB Rentals’ logo and identification numbers must never be concealed or removed.
9. Company Rights
McB Rentals retains the right to terminate or modify services at any time. The right to change prices or fees also lies solely with McB Rentals. The Company reserves the right to enforce these Terms and Conditions and may amend them with notice to customers.
10. Damaged or Lost Equipment
- Customers are solely responsible for any loss, including theft, and/or damage to the equipment during the rental period.
- In the event of loss or damage, Customers agree to pay the rental rate for the time McB Rentals is deprived of the equipment until it is repaired or replaced.
- McB Rentals will notify the Customer of any issues within 48 hours of the item’s return. The Company will handle all necessary repairs.
11. Equipment Valuation
The value of the equipment, in the event of damage or loss requiring replacement, will be determined by the cost of a similar replacement device as determined by McB Rentals.
12. Indemnification
Customers agree to assume full responsibility for the safekeeping and return of all rented equipment. Customers indemnify and hold McB Rentals harmless from any liability, claims, damages, or costs, including legal fees, arising from the Customer’s use, misuse, or possession of the rented equipment.
13. Authority Warranty
Customers warrant that any individual directed to receive equipment from McB Rentals or who signs for acceptance is authorized to do so. This authorized individual is bound by the same terms of this Agreement. Customers waive any obligation on the part of McB Rentals to confirm this authority.
14. Customer and Edits
If any part of this Agreement is found to be void, the remaining provisions will remain binding. This document may only be amended through a written agreement between the Customer and McB Rentals.
15. Title and Limitation of Liability
Ownership and all rights to the equipment remain with McB Rentals at all times. McB Rentals shall not be liable for any loss suffered by the Customer or any third party. Customers assume full responsibility for claims related to the safekeeping and return of all rented equipment.
16. Non-Exclusivity/Non-Assignment
This Agreement is non-exclusive. Customers may not sell, sublease, or assign any rights or obligations under this Agreement to any other person or entity.
17. Choice of Law
The laws of [Insert State/Country] shall govern this Agreement. Customers agree that any action arising from this Agreement shall be brought solely in a state or federal court located in [Insert State/Country], and Customers consent to the jurisdiction of such courts. McB Rentals is entitled to full reimbursement for attorneys’ fees and court costs from the Customer in the event of legal action.
18. Confidentiality/Privacy
Customers agree not to disclose the terms and conditions of this Agreement or any related discussions to third parties, unless required by law. Customers shall not disparage McB Rentals or its officers, directors, employees, or successors.
19. Termination
- By the Customer: Customers can terminate the agreement by giving written notice. If the rental period has started, the full rental fee is due. If canceled before pickup or delivery, 70% of the payment will be refunded.
- By McB Rentals: The company can terminate the agreement if the Customer breaches terms, damages equipment, provides false information, or fails to make payments. Immediate return of equipment is required, and additional fees may apply for late returns or repossession.
- Effect of Termination: Upon termination, no refunds are issued unless specified. Customers are responsible for returning equipment and covering any associated costs. Obligations regarding equipment care and payment for damages continue even after termination.
- Early Return: No refunds for early returns unless agreed in writing.
Without Cause: McB Rentals may terminate without cause with 24 hours’ notice and refund the unused rental period on a prorated basis.
20. Modification of Terms
These Terms and Conditions may be updated as needed, with modifications communicated through email and on our social media platforms.
21. Severability
If any part of these Terms is found to be unenforceable or invalid, the remainder will still be enforceable.
22. Entire Agreement
These Terms represent the entire Agreement between McB Rentals and the Customer, superseding any prior agreements or understandings.
